90837 Plus 90847 or 90853 on the Same Day: What NCCI and MUEs Allow

Can you bill 90837 and 90847 for the same client on the same day?

On a Medicare claim, yes, when the individual hour and the family session are separate services delivered in separate time intervals and the claim carries a bypass modifier. Medicare's National Correct Coding Initiative pairs the two codes: 90847 sits in Column One and 90837 in Column Two, so 90837 is denied unless a clinically appropriate NCCI PTP-associated modifier is reported with it 1.

The pair has been edited since October 1, 2020, with no deletion date, and the rationale CMS prints beside it is a CPT or CMS manual coding instruction rather than a clinical judgment about the two services 1. It carries modifier indicator 1. The same is true of 90853 with 90837: group psychotherapy in Column One, the individual hour in Column Two, indicator 1 1.

But two individual psychotherapy codes on one date have no such opening. In the same file, 90837 with 90834 is an active mutually exclusive edit carrying indicator 0, and 90791 with 90837 is indicator 0 as well 1. Indicator 0 means no modifier bypasses the edit under any circumstances 2.

What the modifier indicator on a pair tells you

The modifier indicator is a single digit in the edit file, and it answers whether a second code can be argued for at all. CMS defines three values: 0 means the edit cannot be bypassed with a modifier, 1 means NCCI PTP-associated modifiers may be used to bypass it under appropriate circumstances, and 9 means the indicator is not specified, which CMS uses where the deletion date equals the effective date 2.

The four psychotherapy pairs a solo practice hits most often, as they appear in the practitioner file effective October 1, 2026:

Primary care meets the same mechanic in the preventive plus problem visit, where a second service on one date survives because a modifier carries it and a note supports it.

The condition the manual attaches: a separate time interval

The NCCI Policy Manual states the condition: family psychotherapy focused on the patient may be reported separately with 90832 through 90838 on the same date of service only if it was performed as a separate and distinct service during a separate time interval 4. An indicator of 1 only permits the argument; this sentence is what the argument has to meet. Two overlapping halves of one continuous hour do not meet it.

The same section already accounts for the family member in the room. Codes 90832 through 90838 include all psychotherapy provided to a patient with family members present as informants for a single date of service 4. A partner present as an informant during the individual hour is inside the code you are already billing.

So the schedule decides this, and it decides it before the session starts.

The shape to build toward is two clocks, one visit: an individual block and a family block with a real boundary between them, each with its own participants and its own focus. Medicare covers family psychotherapy with or without the patient present, as medically reasonable and necessary, when patient treatment is the primary purpose 5, which is what lets the family block be a different service rather than a continuation. CMS draws the category lines the same way: 90832 through 90838 is psychotherapy with the patient, 90846 and 90847 are family psychotherapy, 90853 is group psychotherapy other than of a multiple-family group, and 90849 is the multiple-family group code 5.

Two blocks also land in your caseload math: a 53-minute individual session plus a distinct family interval is most of a two-hour block spent on one client.

The second gate: units, and a number you cannot look up

A pair can clear the procedure-to-procedure edit and still fail on units. A Medically Unlikely Edit is the maximum units of service reported for a code on the vast majority of appropriately reported claims by the same provider for the same beneficiary on the same date of service, and CMS notes that not every code carries one 6.

For the psychotherapy codes you cannot look the ceiling up. CMS publishes most MUE values and keeps others confidential 6, and the Practitioner Services MUE Table effective October 1, 2026 contains no rows at all for the psychiatry range that holds these codes 6. That leaves no figure to put in your billing notes.

What is public is how the edits adjudicate. Where an MUE is a claim-line edit, CMS says appropriate modifiers may be used to report the same code on separate claim lines, each adjudicated on its own; an absolute date-of-service edit may not be overridden by a contractor, and a clinical-benchmark edit may be bypassed on medical review 2. Contractors also keep their own rules limiting these modifiers with some codes 2.

For timed services the manual says that if two separate and distinct timed services are provided in separate and distinct time blocks, modifier 59 may be used to identify them, and the blocks may be sequential or split 2. A practitioner may not perform several services each for the minimal reportable time and report each as a separate unit 2.

One setting permits more than one unit of an individual psychotherapy code in a day: a Medicare partial hospitalization or intensive outpatient program, where 90832 through 90838 may be reported with more than one unit 4. Outside it the manual says nothing either way and the ceiling is confidential, which leaves two units of 90837 on an office date unsupported by anything a solo practice can read.

What the note has to show for the second service

Two entries, two intervals, two purposes. One Medicare contractor, First Coast Service Options in Jurisdiction N, publishes the time bands behind the individual code choice: 16 to 37 minutes for 90832 and 90833, 38 to 52 minutes for 90834 and 90836, and 53 or more minutes for 90837 and 90838, with psychotherapy of less than 16 minutes not reported at all 7. That article binds Florida, Puerto Rico and the U.S. Virgin Islands.

It is one contractor's statement of expectations, and it is useful because it writes down what a reviewer looks for. The same article expects start and stop times in the record 7. On a same-day pair that expectation does real work: the start time of the second service is the evidence that the interval was separate.

Write each entry to stand on its own: participants, focus, intervention, response, plan. The golden thread runs through both, and a single note describing an afternoon collapses two services into one no matter which modifier the claim carries.

If the family session brings in a partner who is also your client in their own right, the chart wall between related clients is a separate problem from the coding one. Billing both services under one claim does not merge the two records, and it does not license one entry to describe both people.

Look the pair up yourself, and again next quarter

Every pair-level fact on this page came out of a file anyone can download. CMS hosts the practitioner procedure-to-procedure edit files on its NCCI PTP edits page, and each row carries the Column One code, the Column Two code, the effective date, the deletion date and the modifier indicator 1. Search the file for your two codes, read the indicator, and note the file version you read.

Do it again on a schedule. CMS replaces the published PTP and MUE files quarterly and updates the policy manual annually, so the answer you write down carries an as-of date whether or not you print one 3.

These are Medicare's edits, and that is the boundary on all of it. Whether a commercial payer or a state Medicaid program applies the same pair, the same indicator, or a same-day policy of its own is answered only in that payer's published policy. The same gap covers which bypass modifier a payer wants here: CMS names modifier 59 and the more specific X subsets and warns that contractors limit them by code 2, but nothing in the CMS files and manuals read here states a preference for the 90847 and 90837 pair.

No. The NCCI Policy Manual states that codes 90832 through 90838 already include all psychotherapy provided to a patient with family members present as informants for a single date of service. A partner sitting in for part of the individual hour is inside the code you are already billing. A separately reportable family session has to be a distinct service in its own time interval, with its own participants and its own focus.

Not on a Medicare claim. Because psychotherapy includes continuing psychiatric evaluation, the policy manual treats 90791 and 90792 as not separately reportable with individual, group, family, crisis or other psychotherapy codes for the same date of service. The edit file backs that up: the 90791 and 90837 pair carries modifier indicator 0, which means no modifier bypasses it under any circumstances.

The manual permits more than one unit of 90832 through 90838 in a Medicare partial hospitalization or intensive outpatient program. For an ordinary office date it says nothing either way, and the unit ceiling for the psychotherapy codes is one CMS holds confidential, so no published figure supports the second unit. Two distinct services under two different codes is the better-supported route.

CMS names modifier 59 and the more specific X subsets as the NCCI PTP-associated family, and the manual permits modifier 59 where two separate and distinct timed services occupied separate and distinct time blocks. It also warns that claims processing contractors keep their own rules limiting these modifiers with some codes. No source in the CMS material read here states a preference for this particular pair, so check your payer's published policy.
