Medicare Enrollment as an LPC or LMFT: 855I Specialty and Hours

Which federal category covers an LPC or an LMFT?

Medicare has covered marriage and family therapist and mental health counselor services since January 1, 2024, when the CY 2024 Physician Fee Schedule final rule implemented Section 4121 of the Consolidated Appropriations Act, 2023 1. An LMFT enrolls under the marriage and family therapist definition. A licensed professional counselor enrolls under the mental health counselor definition, which is where that title lives in federal regulation.

42 CFR 410.54 names state titles that qualify, among them mental health counselor, clinical professional counselor, and professional counselor. The same section requires a master's or doctoral degree that qualifies for licensure or certification under state law, the supervised experience condition below, and licensure or certification by the state where the services are performed 2. The marriage and family therapy version at 42 CFR 410.53 is built the same way, in the same order 3.

Read your own licence against the section before you open the form. Both sections also exclude services furnished to an inpatient of a Medicare-participating hospital, so what you are enrolling to bill is the outpatient work a private practice does 23. The 2024 rule created the benefit category; the application asks you to show you fit it.

What goes in the specialty field on the CMS-855I

There is no MFT or MHC checkbox printed on the paper form, and hunting for one is where this application stalls. CMS's enrollment FAQ instructs both professions to select the undefined non-physician practitioner specialty option in section 2H of the CMS-855I and to write in MFT or MHC 4. PECOS carries both specialties for online submissions 4.

So the first real choice on the 855I is PECOS or paper, and the two paths differ at this step: PECOS lists the specialty, and the paper form needs the write-in done correctly.

Your NPPES record has to agree with the specialty you claim. The MFT taxonomy code is 106H00000X and the MHC taxonomy code is 101YM0800X 4. A practitioner may hold only one Type 1 NPI, so an existing NPI carries over: update the taxonomy on the number you already have rather than applying for a second one.

CMS says a future update of the paper form will add these specialties 4. But the instruction naming section 2H is dated May 2024, and a reissued form can renumber its sections, so check the revision printed on the copy you download against the current FAQ before you file.

The 2 years or 3,000 hours, and what proves it

Federal regulation sets one experience condition for each profession, worded the same way twice. A mental health counselor must have performed at least 2 years or 3,000 hours of post-master's-degree clinical supervised experience in mental health counseling in an appropriate setting, such as a hospital, skilled nursing facility, private practice or clinic 2. Its counterpart for marriage and family therapists reads identically 3.

What you have to prove depends on your own state's licensure route. Where that experience was already required for the licence you hold, CMS says no separate proof is needed, because the MAC validates it from the licence itself. Where it was not required, documentation travels with the application: statements on letterhead from the setting's supervisor or an authorized official, plus a statement from a state licensing or credentialing body or from a national MFT or MHC credentialing organization, and CMS states that email is not acceptable 4.

The regulation's phrase is post-master's-degree clinical supervised experience, and the CMS FAQ does not sort out whether pre-licensure associate or registered-intern hours stand on their own. If your licence did not require those hours, send the documentation above and let your MAC decide.

Fee, screening, signature, and one application per state

None of this costs an application fee. CMS screens MFTs and MHCs at the limited risk level and states that they are not required to pay a Medicare application fee 4. Only the enrolling practitioner may sign, on paper or in PECOS, and CMS states that the authority to sign cannot be delegated to anyone else, a billing service or a credentialing consultant included 4.

A separate CMS-855I enrollment is required in each state where services are rendered, with the licence for that state on that application, and separate enrollments produce separate PTANs 4. That is the constraint to plan around if you see clients across a state line or by telehealth into a second state, because it is two applications and two identifiers rather than one of each.

Medicare recognizes a licence obtained through an interstate licensure compact pathway as a valid, full licence for meeting its federal licensure requirement 4.

How long it takes, and when billing privileges start

CMS's stated targets are generally 15 calendar days for a clean web application and 30 calendar days for a clean paper one, and CMS says those timeframes may be extended where the application is incomplete 4. So the processing time for an 855I turns on the word clean. If your MAC issues a development letter, the response window is 30 calendar days, and an application that misses it is rejected rather than held open 4.

The date that decides the money is the filing date. For a non-physician practitioner, billing privileges take effect on the later of the filing date of an enrollment application that was subsequently approved, or the date the practitioner first began furnishing services at the new practice location 5.

Some of the gap before that date is recoverable, and not all of it. Up to 30 days of services before the effective date may be billed retrospectively where circumstances precluded enrolling in advance and all program requirements, state licensure included, were met, and the window is 90 days where a Presidentially declared disaster precluded enrolling in advance 6. A floor sits under the whole benefit as well: no MFT or MHC receives an enrollment effective date earlier than January 1, 2024, the day billing opened 14.

What enrolling commits you to

Enrollment is a set of terms, not only permission to bill. An enrolled MFT or MHC must accept assignment, and Medicare pays 75% of the Physician Fee Schedule amount a clinical psychologist would receive 7. Medicare also does not cover services furnished incident to an MFT's or MHC's own professional services, though those services can be covered as auxiliary personnel incident to a physician, clinical psychologist, NP, PA, CNS or CNM 7.

Those two rules decide what a Medicare panel is worth to a solo practice, and they decide it before a single claim goes out. Accepting assignment means the fee schedule amount is the amount collected, and the 75% relationship sets that amount against the clinical psychologist rate rather than against your own fee.

Whether to enroll is yours to decide. Run the fee schedule against what the practice collects now, count the visits a newly Medicare-eligible LPC could bill that go unbilled today, and decide on your own numbers.

The order to do it in

Nothing above needs a credentialing consultant, and the sequence fits on one page. Confirm the licence and the experience condition, set the taxonomy, choose the filing path, file with the section 2H write-in, then watch for a development letter. The item to settle first is the date you will first furnish services at the practice location, because that date shares control of your effective date with the filing date.
